The federal government has again applied to the federal high court in Abuja for protection of witnesses billed to testify against the former National Security Adviser, Sambo Dasuki in the criminal charges of unlawful possession of firearm Harms and money laundering.

In a fresh motion on notice brought to the court on wednesday, the government prayed the court for an order to shield the identities of the witnesses and that the record of proceedings not to be made accessible to the public.

In the motion filed by federal government lawyer, Mr. Oladipo Opeseyi (SAN), the applicant also applied for an order to permit the witnesses to be addressed with Pseudo names in the cause of the trial of the Ex-NSA.

The trial Judge, Justice Adeniyi Ademola had in February dismissed similar motion on protection of witnesses brought to the court by the Federal Government on the ground that the motion was baseless and unwarranted.

The judge said that the same government cannot aske for protection of witnesses having filed the charges and proof of evidence along with the anmes of the witnesses and put the same at the public domain for public consumption.

The former National Security Adviser, Colonel Mohammed Sambo Dasuki has asked an Abuja High Court to consolidate the two criminal charges bordering on alleged corruption and breach of trust brought against him by the Federal Government in the course of his official duties.

Dasuki who had been granted bails in three different high courts were criminal charges were slammed on him, had been rearrested and kept in custody since 2015.

He told the court that he was not scared of trial on the alleged fund misappropriation but insisted that the right thing in law must be done.

The Ex-NSA in a fresh motion on notice filed by his counsel, Mr Joseph Daudu (SAN) claimed that the trial in two different courts on the same issues and facts is unconstitutional and prejudicial to his right to fair trial by the court.

Dasuki who is standing trial on allegation of alleged misappropriation of $2.1bn along with four others before Justice Baba Yusuf insisted that the charges against him by the complainant on the same issue constituted a gross abuse of court process.

Daudu also urged the court that he should compel the federal government to obey the court order and save the judiciary from embarrassment of disobedience. "Judges must assert the efficacy of their orders," he concluded.

However, while opposing the motion, counsel to the Federal Government, Mr. Rotimi Jacobs, informed the Judge that the motion was an abuse of the court process because there was no evidence placed before the court that the accused was rearrested by the Economic and Financial Crimes Commission (EFCC).

In the application, Dasuki is praying for an order of court prohibiting the Federal Government from further prosecuting him on the N19 billion alleged fraud or any other charge or seeking any form of indulgence before any court in the country, until the order admitting him to bail is obeyed.

He also wants an order discharging him of all the offenses contained in the charge on ground that the charge cannot not lawfully‎ prosecuted by a government that is in brazen disobedient of a lawful court order.

Alternatively, the ex NSA prays for an order staying further proceedings in the charge until he has exhausted the remedies available to him in law for the enforcement of his right to liberty as preserved by the bail order granted him.
