Fact-Check: Does COVID-19 Vaccine Change Human Status, Legal Rights Patentable Products?
Claims: There’s a claim shared on social media platforms suggesting that people who received mRNA-based COVID-19 vaccines are now patented and legally “no longer human”. This claim is allegedly linked to a US Supreme Court ruling related to mRNA COVID-19 vaccine.

“In the United States, the supreme court has ruled that vaccinated people worldwide are products, they are now patented goods.
“According to the USA law which can be verified, people who have been vaccinated no longer qualify as human and therefore they can no longer be categorized as human beings.
“In essence this means that those vaccinated are no longer subject to national or international law. Since 2013, all people vaccinated in genetically modified mRNAs are legally trans-human and legally identified as transhuman, they no longer enjoy any human or other rights of a state.
“The surprise worldwide because Genpoint Technology patents are under US jurisdiction and laws where they were registered. Yes this exists, but it’s another form of dividing all of us from each other.
“I certainly addressed all other people, the vaccinated and the unvaccinated and we are all in this together, our hope that we can retain humanity in whatever way we can as this huge onslaught that we were not prepared for, we kept believing in the mainstream media which convinced us that it’s far in the future when really it’s been set up all around us.
“For the last 20-25 years, the GNO Engineering piece has been part of this setup and has been going on and we have all believed in the mainstream media accounts that it’s about climate change, global warming, carbon and none of it was true. It’s about entirely preparing for a trans-human history.”
Verification: In an effort to verify the claims made in the viral video, PRNigeria fact-check team utilized reverse image search technology to analyze the footage and determine its authenticity, by using key-frame extraction, which led to an existing media detailing almost the same claims made in the video.
One of such media is a video report which seems to collaborate Elana’s claims in the viral footage.
The viral video, lasting just two minutes and fourteen seconds, began circulating on social media platforms during the first week of January 2024, garnering widespread attention and sparking curiosity among users.
Fact-check investigation revealed that YouTube has taken down the video for violating community guidelines. Similarly, the poster of the video footage on TikTok has also deleted it.
Additional probing uncovered the identity of the speaker in the video as Elana Freeland who is an author and speaker known for her work on subjects like geoengineering and electromagnetic warfare. Regarding COVID-19 vaccines, she has been associated with conspiracy theories and alternative narratives about public health practices.

The 2013 US Supreme Court ruling in Association for Molecular Pathology v. Myriad Genetics, Inc. does not mention mRNA vaccines or suggest that vaccinated humans can be patented. The ruling actually states that patent protection only applies to artificially created DNA sequences, not naturally occurring ones. This ruling has no relevance to the claim that vaccinated individuals can be patented.
The Supreme Court case Association for Molecular Pathology v. Myriad Genetics, Inc. was about gene patenting. The court ruled that natural gene sequences can’t be patented, but synthetic cDNA (not found in nature) can. This ruling has no connection to mRNA vaccines or the legal status of individuals who receive them, and does not imply that vaccinated individuals can be patented.
Experts have clarified that receiving a vaccine, including mRNA COVID-19 vaccines, does not change a person’s human rights or legal status. The mRNA technology used in these vaccines does not modify the human genome or DNA, but rather instructs cells to produce a protein that triggers an immune response.
Additionally, US law (Section 33(a) of the America Invents Act), Elana Freeland made reference to, explicitly prohibits the patenting of human organisms, ensuring that human beings and their biological makeup cannot be patented, and preserving human rights and legal status regardless of medical interventions like vaccines.
