ICPC Opposes El-Rufai’s Fresh Bail Application as Court Adjourns Hearing to May 13
The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has opposed a renewed bail application filed by former Kaduna State Governor, Mallam Nasir El-Rufai, in an ongoing case before the Kaduna High Court.
At Tuesday’s resumed proceedings, defence counsel, Mr. Ubong Akpang, notified the court of the pending application, stressing that it concerns the defendant’s fundamental right to liberty. He stated that all requisite processes had been duly filed and served, and indicated readiness to proceed.
In response, counsel to the ICPC, Mr. Ibrahim Mukhtar, informed the court that the prosecution had only just been served with the defendant’s further affidavit in support of the application. He requested additional time to review the new filings.
Consequently, the presiding judge, Honourable Justice D.H. Khobo, adjourned the matter to May 13, 2026, for hearing of the bail application.

The court had earlier denied bail to El-Rufai, citing his failure to file a further affidavit addressing new issues raised in the ICPC’s counter-affidavit. The prosecution had argued that the defendant posed a flight risk due to his influence and resources, and alleged obstruction of lawful arrest at the Nnamdi Azikiwe International Airport, Abuja. Additional concerns included refusal to surrender travel documents and electronic devices, as well as the potential to interfere with witnesses and evidence.
In its ruling, the court reiterated that bail remains a discretionary relief guided by the interests of justice. Justice Khobo noted that the defendant’s status could undermine ongoing investigations, particularly as some suspects are still at large. The court also held that the defendant’s failure to controvert key allegations amounted to an admission, and dismissed health-related claims as unsubstantiated.
Bail was consequently refused, with the defendant ordered to remain in ICPC custody pending trial, alongside a directive for accelerated proceedings.
Despite the ruling, the defence proceeded to file a fresh application for bail, which the ICPC has formally opposed.
The Commission reaffirmed its commitment to due process and the diligent prosecution of corruption cases.
